In 2012, the United Kingdom actively sought to tackle acts of stalking through amendments to the Protection from Harassment Act 1997. Now, not only is stalking a recognised criminal offence, acts associated with stalking behaviour have finally been properly defined in legislation. Further, the role of technology in digital stalking offences, frequently termed as acts of cyberstalking, has been duly highlighted. The prosecution of such cyberstalking offences is reliant on the forensic analysis of devices capable of communication with a victim, in order to identify the offender and evidence the offending content for presentation to a court of law. However, with the recent proliferation of anonymous communication services, it is becoming increasingly difficult for digital forensic specialists to analyse and detect the origin of stalking messages, particularly those involving mobile devices. This article identifies the legal factors involved, along with a scenario-based investigation of sample anonymous and spoof SMS (Short Message Service) messages, documenting the evidence that remains on a victim's handset for the purpose of locating an offender, which often may be minimal or non-existent.  相似文献

数字经济具有高技术性、高成长性、高融合性、高协同性特征,数字经济发展在增加经济系统高端要素投入数量的同时,实现了对传统要素质量的改造升级,提升了要素生产效率。而且,数字经济可降低要素配置成本,盘活市场中"沉睡"的要素资源,激发要素蛰伏的潜能,优化要素市场化配置规模和效率。进一步的实证检验得出:数字经济的经济高质量效应显著为正,要素市场化在数字经济推进经济高质量发展中的中介效应显著;东部地区数字经济的高质量发展效应与要素市场化的中介效应均高于中西部地区。为推进经济高质量发展,应加快培育壮大数字经济新动能,加强数字经济治理体系完善和治理能力提升;进一步完善要素市场化配置体制机制,提高要素市场化配置规模和效率;完善区域数字经济与要素市场化协调政策,推进区域经济协同发展。  相似文献

Cyber attacks continue to increase in frequency and variety, making cyber malfeasance a rising area of study and a major policy issue. Categorizing cyber attackers aids targeted organizations in efficiently directing resources to enhance security. However, extant hacker typologies do not fully account for the multifaceted nature of cyber malfeasance, including the rise in socially and ideologically motivated hacking (e.g. crowdsourcing, hacktivism). I clarify the current state of the field by uniting recent case studies on hackers with existing categorization techniques. Previous researchers have employed circumplex models—visualizations which depict relationships and boundaries between groups—as a way to organize hacker types. I propose an updated model—a weighted arc circumplex model—that is designed to represent the multidimensional nature of contemporary hacker types by offering a means of visually representing multiple motivations simultaneously. Finally, I demonstrate how archetypical circumplex models can be wed with sociograms to depict social and technical relationships between hacker groups.  相似文献

How is it that digital investigators are always busy and still never have enough time to actually dig deep into digital evidence? In this paper we will explore the current implementation of the digital forensic process and analyze factors that impact the efficiency of this process. Next we explain how in the Netherlands a Digital Forensics as a Service implementation reduced case backlogs and freed up digital investigators to help detectives better understand the digital material.  相似文献

基层政策执行会出现偏差已经成为学界的共识,但是对于此问题的分析机制并不明晰,多数研究均是从单一视角予以阐释。通过深入考察易地搬迁中“拆旧复垦”政策的具体执行过程,从自上而下与自下而上相互融合视角入手,讨论“拆旧复垦”政策如何在不同利益主体的互构下发生了转变,为何完美的指标数据与文字背后却发现政策执行陷入模糊或搁置状态。从案例解构结果来看,在发展导向的逻辑下,基层政府通过主动加码寻求搬迁规模最大化以谋求在“数字竞赛”中胜出;在压力型体制的上下博弈中,基层政府采取拼凑应对的模糊执行策略以有效应对自上而下的政绩考核;在不完全信息状态的混合博弈中,政策受众在理性计算之下与基层政府形成了“合谋的沉默”。文章的贡献在于,对基层政策执行偏差的解释没有囿于讨论科层结构的弊端,而是从政策设计本身以及不同利益主体互构的视角出发解读其内在逻辑。  相似文献

The prominence of technology usage in society has inevitably led to increasing numbers of digital devices being seized, where digital evidence often features in criminal investigations. Such demand has led to well documented backlogs placing pressure on digital forensic labs, where in an effort to combat this issue, the ‘at-scene triage’ of devices has been touted as a solution. Yet such triage approaches are not straightforward to implement with multiple technical and procedural issues existing, including determining when it is actually appropriate to triage the contents of a device at-scene. This work remains focused on this point due to the complexities associated with it, and to support first responders a nine-stage triage decision model is offered which is designed to promote consistent and transparent practice when determining if a device should be triaged.  相似文献

全球大型数字平台通过"复制、收购与扼杀"的策略扼杀并购了大量初创企业,引发了创新赛道垄断的顾虑。初创企业并购通常不会引起显著的市场结构变化,但随着时间推移,平台"切香肠式"的扼杀式并购,在扼杀潜在竞争对手、强化自身市场支配地位的同时,更会扭曲长期创新供给,致使未来市场可竞争性丧失。而并购效率改进收益的消亡、创业者奖励作用的证伪与动态竞争约束工具的全面失灵,进一步要求反垄断执法机构应摒弃目前普遍不作为的监管做法,及时识别与规制平台扼杀式并购。对此,有必要引入内部文档调查、并购价格组成分析等并购动机过滤机制,识别出那些出于消除未来竞争威胁或扼杀潜在迭代式创新目的的初创企业并购;同时,通过引入补充性的申报门槛、设定更具针对性的审查补救措施与授权必要的事后调查,将能有效地遏制平台资本的无序扩张,为初创企业创造一个不受主导平台扼杀式并购威胁的现代化营商环境。  相似文献
